Job Description

M&T Bank Counsel – Digital Services and Emerging Payments Preferred Location- Buffalo, NY Alternate Locations: Wilmington, DE or NYC, NY
 
The successful candidate will be based in (i) Buffalo, NY, (ii) New York City or (iii) Wilmington Delaware, and will support business units of M&T Bank Corporation (and its affiliates) (“MTB”) that provide digital banking services and that are involved in emerging payment initiatives.  Digital services include MTB’s public-facing websites, online banking platforms, telephone banking and mobile banking.  Emerging payment initiatives include real-time-payments, person-to-person payments and emerging authentication technology, such The Clearing House (TCH) real-time-payment system, Zelle payment service, Apple Pay and Google wallet and payment solutions.  In particular, business units that provide digital banking services concentrate on the use of electronic and emerging technology to develop and enhance products, services and customer experience related to cards, payments and other consumer and business online banking activities.    More specifically, this candidate will provide legal support for:    
Day-to-day legal matters for the business lines that provide digital banking services and that are involved in emerging payment initiatives  
Advice on the development and implementation of new digital and emerging payment products and services, such as mobile banking applications, digital wallets and real-time payments  
Initiatives to enhance digital engagement and interaction with customers, such as social media initiatives and initiatives to enhance customer-experience and usage of digital services  
Drafting and updating template contracts and forms for the provision of digital services and emerging payment services, such as MTB’s Digital Services Agreement  
When necessary, drafting and negotiating contracts with consumer and business customers for the provision of digital services and emerging payment services  
Advice on relevant federal and state consumer and non-consumer laws and regulations relating to digital services and emerging payments, including the E-Sign Act and UETA, Telephone Consumer Protection Act (TCPA), Data Privacy laws, FFIEC Guidance on Authentication,  Electronic Funds Transfers Act (EFTA) and Regulation E, Uniform Commercial Code Article 4A and UDAAP  
Overseeing any outside counsel used to provide legal advice on digital services and emerging payments  
Participating in industry meetings and groups, including The Clearing House (TCH), to keep abreast of laws and issues affecting digital services and emerging payments  
Participating in MTB committees relating to digital services and emerging payments  
Working with Compliance, Risk, Vendor Management, Privacy Office and Audit with respect to digital services and emerging payments  
Advising senior management and other personnel on pertinent legal and regulatory developments, including legal risks, affecting digital services and emerging payments  
Minimum Qualifications
 
J.D. degree required.  Licensed to practice law in, as applicable, New York or Delaware (or ability to obtain an in-house counsel license in New York or Delaware, as applicable).  
Minimum of 3 plus years plus of relevant experience    
Ability to handle multiple tasks, take on new responsibilities and prioritize work in a deadline-intensive environment; experience in leading and facilitating change  
Ability to understand and integrate details of business/operational/systemic environment in applying legal and policy requirements  
Experience advising digital services and/or payments laws  
Experience identifying, evaluating and escalating legal risk issues  
Strong communication skills to deal with internal and external constituencies, including senior business leaders; external counsel; risk, compliance and audit counterparts at the organization; counterparts at other companies; and industry representatives  
Exceptional written and verbal communications skills; ability to communicate and relate at all levels of the organization  
Strong interpersonal and teamwork skills and ability to influence through collaboration  
Demonstrated experience in leading others, both through direct relationships and/or indirectly (influencing without direct authority)
