The Senior Compliance Advisor in the Compliance Risk Management (“CRM”) organization will take on a key leadership role in identifying, assessing, and mitigating risk (including but not limited to operational and regulatory risks) applicable to the Wealth and Institutional Services Division (“WISD”). The role aims to foster an environment of regulatory awareness and ensure regulatory compliance in a responsive and collaborative fashion with WISD leadership. The Senior Compliance Advisor will interact with WISD lines of business, legal, risk committees, working groups, audit, regulatory affairs, and State and Federal Regulatory Agencies. The role will liaison across 1st and 2nd lines of defense on an ongoing and regular basis to ensure the Bank is operating within the Bank’s risk appetite.
Understand and evaluate new or revised regulatory requirements and assist in the development of appropriate policies and procedures to achieve compliance.
Provide timely and thoughtful regulatory expertise in response to WISD initiatives, line of business guidance requests, internal and external audits, and regulatory examinations.
Evaluate the sufficiency of existing processes and recommend new ones that most effectively anticipate, manage, and reduce risk to WISD.
Maintain a thorough knowledge and understanding of the laws, rules, regulations with which WISD must comply and an awareness of issues of recent regulatory focus.
Disseminate any changes and/or new regulatory guidance impacting WISD activities.
Monitor regulatory compliance issues and developments under applicable rules, laws, and regulations; design or modify policies and procedures to achieve compliance and to prevent and detect violations of regulatory requirements.
Create and distribute risk reports for WISD in order to document and communicate the monitoring of potential risks; escalate risks as appropriate.
Develop and communicate recommendations that support adherence to regulations and industry best practices.
Assess compliance issues presented through new/revised product and service offerings and work closely with lines of business to plan a response.
Provide guidance for WISD-specific operational projects and initiatives with regard to compliance standards and mitigation of risk.
Liaison with CRM Program Specialists and assist CRM staff in the execution of CRM program components.
Identify, measure, and escalate compliance risk issues to the Director of WISD Compliance, the lines of business, and 1st and 2nd Lines of Defense, as necessary.
Understand and adhere to the company’s risk and regulatory policies and procedures.
Maintain M&T internal control standards, including timely implementation of internal and external audit points together with any issues raised by external regulators as applicable.
Promote an environment that supports diversity and reflects the M&T Bank brand.
Complete other related duties as assigned.
WISD Compliance: Includes but not limited to Trust Laws and regulations (federal and state) related to the Federal Reserve Bank of New York, Office of the Comptroller of the Currency, State of Delaware, Securities Act of 1933, and the Securities Exchange Act of 1934.
The Senior Compliance Advisor works under general supervision of the Director of WISD Compliance but exercises a high level of judgment and discretion to resolve problem situations independently. Effective communication and collaboration with WISD Senior Leadership and M&T Bank Executive Management is expected in the role. The Senior Compliance Advisor must understand when situations warrant escalation to the M&T Bank Chief Compliance Officer, Legal, or when other consultation is needed.
The Senior Compliance Advisor position is essential to ensuring compliance within WISD. Failure to adhere to regulations could result in significant long-term negative impact due to severe penalties from regulators and to legal and reputational risk.
This position must maintain positive working relationships with CRM staff, business line owners, as well as maintaining significant contact with 2nd Line Risk Management, Legal, Audit, and other M&T subsidiaries and departments. The Senior Compliance Advisor also interacts with external contacts, including regulators/examiners, vendors, and peer companies.
May provide indirect leadership to team of CRM Program Specialist
Bachelor’s degree and a minimum of seven years’ relevant experience in Legal or Trust environment, or in lieu of degree, a combined minimum of eleven years’ higher education and or relevant experience in Legal or Trust environment.
Three years’ work leadership experience required;
Ability to read and understand laws, rules, regulations and common law applicable to the subject matter;
Ability to effectively communicate verbally and in writing with all levels of management across the bank;
Ability to coordinate and work collaboratively with internal and external contacts on a daily basis;
High degree of integrity;
Maintain discretion in connection with all confidential human resources and compliance matters and proprietary information.
Juris Doctor or Master’s degree preferred;
Thorough knowledge of operations, systems, and practices within subject matter business units
Knowledge of bank-wide policies and procedures in responsible area
